It would seem that the new fashion amongst lawyers is to try to silence Parliament, following on from Carter Fuck trying to stop Trafigura we now have Withers LLP trying their hand at preventing MPs talking about things in Parliament. This time though it’s not about dumping toxic waste in the third world but local planning issues, the full story is over at The Guardian. The key par of the e-mail sent by Withers LLP though is this gem:

“”In order to settle this matter we, therefore, require an apology in respect of both the serious allegations plus payment of our client’s costs, a substantial payment to a charity of his choice and an undertaking not to repeat the allegations or any similar allegations, particularly in parliament.

“Your threat to make a statement in the House of Commons referring to our client’s alleged ‘spoiling tactics’ in this and other situations and that our client’s threatened proceedings amount to ‘bullying and an attempt to gag opponents’ is tantamount to blackmail.

“These allegations are untrue as our client is only trying to put right a serious wrong to his reputation. We note that you would only make these allegations under the cover of parliamentary privilege. My client objects very strongly to you doing this and would ensure, via other sources, that the House of Commons were fully appraised of the true situation and not misled.”

Which Withers LLP claim is not in any way an attempt to limit John Hemming MP’s parliamentary privilege. I guess he could say what he liked as long as he didn’t mention their client. On the bright side our glorious parliamentarians are actually at least thinking about doing something about it – if we’re really lucky they might accidentally become concerned about our freedoms whilst they’re at it. Maybe reform the odd bit of libel law (though at least the offence of criminal libel has gone.)

Again rather late with getting round to posting this update, but for completeness sake I think it best not over looked. Sadly it seems that Trafigura and carter-fuck have had thier day in court and the BBC have issued an apology in open court., as well as £250,000. the full apology from newsnight can be found here. The gist of the statement is basically that experts hadn’t been able to find any link between being exposed to highly toxic slops and “deaths, miscarriages and chronic and long-term injuries”. Of course you might be inclined to still think that perhaps shipping such toxic slops to a poor african nation to be dumped rather than dealing with it in proper facilities isn’t the most ethical, pleasant or enviromentally sound thing to do. But that of course wasn’t the matter before the court.

So it seems that the worlds most loved law firm, Carter-Fuck, are up to their normal tricks again on behalf of that bastion of environmental concern Trafigura.

My attention has been drawn to this post by Richard Wilson, it would seem that Carter-Fuck would really much rather we didn’t see a Panorama report on the wast they dumped on the Ivory Coast. So via yet another gagging order forcing the BBC to take down this video from their web site.

Do spread the word, to make sure that Trafigura get the sort of publicity they deserve on this issue. After all dumping large amounts of toxic chemicals on poor nations that can’t deal with it just to save money, really isn’t a terribly nice thing to do.

 

So like a dose of the clap Carter-fuck are back at it again ( hat tip to Anna Raccoon). They seem to have realised that trying to stop the press reporting on Parliament is a bad move from a publicity point of view, so… now they’re trying to stop Parliament discussing the report about their client Trafigura dumping toxic waste on the Ivory Coast. The plan seeming to be to make use of the convention that Parliament doesn’t discuss matters that are sub judice, so as long as they can keep spinning out proceedings Parliament won’t be able to discuss Trafigura dumping toxic waste on the Ivory Coast and there wil be nothing for the press to report from Parliament and in the meantime everyone will get bored and go away. Simples!

Update A lot more on the Carter-fuck/Trafigura business on the Guardian. There’s also a Petition on number10 to request that press freedom to report Parliamentary business should be enshrined in law. Probably won’t do much good, but never hurts.

Update 2 Guido is reporting that Carter-fuck have thrown in the towel. Having managed to achieve precisely the opposite of what was intended. As explained rather well by Samizdata.
